Law Enforcement Guidelines & Protocols
AVAKRI ("AvaKri", "we", "us", or "our") is committed to maintaining a safe, secure, and respectful environment for our members. We cooperate with official law enforcement agencies in accordance with applicable laws, including the Electronic Communications Privacy Act (ECPA), 18 U.S.C. § 2701 et seq.
1. Overview of Response Protocols
We store and process user information strictly in accordance with our Privacy Policy and Terms of Service. Law enforcement seeking information about an AvaKri account or user must submit a valid, formal legal process (e.g., a subpoena, court order, or search warrant) issued by a court of competent jurisdiction.
2. Required Legal Process
We require law enforcement to provide specific, narrow legal requests:
- Subpoena (Civil or Criminal): Required to request basic subscriber records, such as registered name, email address, phone number, account creation date, IP logs, payment transaction history, or verification status.
- Court Order (under 18 U.S.C. § 2703(d)): Required for non-content transactional logs, including match interaction history or timestamp logs.
- Search Warrant: Required to compel disclosure of the contents of communications or private user notes, where applicable and stored.
All legal requests must specify:
- The legal authority issuing the request.
- The specific user identification details (registered email, phone number, or verified ID reference).
- The exact scope of data requested and date range.
- Official government contact details of the requesting officer or agency.
3. Emergency Disclosure Requests
Under 18 U.S.C. §§ 2702(b)(8) and 2702(c)(4), AvaKri may disclose user records voluntarily to law enforcement if we have a good-faith belief that an emergency involving imminent danger of death or serious physical injury to any person requires disclosure without delay.
To submit an emergency request: Law enforcement officials must send an official emergency disclosure request on agency letterhead from an official government email address containing:
- Detailed description of the emergency involving imminent physical harm.
- Identification of the individual at risk.
- Specific account details linked to the threat.
4. Preservation Requests
We accept formal preservation requests under 18 U.S.C. § 2703(f). Upon receiving a valid request from law enforcement, we will preserve account records for up to 90 days pending the issuance of official legal process.
